These Terms of Service ("Terms") govern your access to and use of the Photo & Craft website (photoandcraft.com, the "Site") and your purchases from our online store. Photo & Craft is operated by Photo & Craft, LLC, a California limited liability company located at 5540 Fulton St, San Francisco, CA 94121 ("Photo & Craft," "we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility & Accounts
You must be at least 18 years old and have the legal capacity to enter into a binding contract to place an order or create an account. By using the Site, you represent that you meet these requirements.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at hello@photoandcraft.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
2. Products & Orders
All products are made to order. Production times stated on the Site are estimates and may vary based on edition, finish, framing, and current studio capacity. We make reasonable efforts to maintain accurate product descriptions, sizes, finishes, and availability, but errors may occur.
Your order is an offer to purchase, which we accept when we send a confirmation email. We reserve the right to refuse, cancel, or limit any order at our discretion, including for pricing or description errors, suspected fraud, payment issues, shipping limitations, or inability to fulfill. If we cancel an order after charging you, we will issue a full refund.
3. Pricing & Payment
All prices are in U.S. dollars and exclusive of applicable taxes, duties, and shipping unless stated otherwise. Sales tax is collected where required by law. Prices are subject to change without notice; the price at the time of order confirmation is final for that order.
Payment is processed at the time the order is placed via Shopify Payments or another secure processor we designate. By submitting payment information, you authorize us to charge the applicable amount. If a payment is declined or reversed, we may cancel the order or pause production until payment is resolved.
4. Cancellations & Modifications
Because every print is made to order, cancellation and modification windows are short. You may request to cancel or modify an order within 24 hours of order confirmation by emailing orders@photoandcraft.com with your order number.
Once production has begun, orders cannot be cancelled. Address corrections may be possible until the order has shipped; please contact us as soon as possible.
5. Limited Editions & Artist Proofs
Edition sizes are strictly maintained. Once an edition has sold out, it will not be reprinted in the same size or finish. Edition numbers are assigned in order of purchase and recorded in our edition registry. Each edition print is accompanied by a Certificate of Authenticity bearing the print number, edition size, artist's signature where applicable, and a unique reference identifier.
The artist and Photo & Craft each retain a small number of artist proofs ("APs") outside the numbered edition, typically not exceeding 10% of the edition size, in accordance with standard fine-art practice. APs are marked as such on their certificates and are not included in the numbered count.
6. Color Accuracy & Print Variation
Monitor calibration varies by device and printed colors may differ slightly from on-screen display. Our prints are produced on calibrated, color-managed equipment using archival pigment inks and museum-grade substrates, and are matched to the artist's approved proof. Minor variations between prints within an edition are inherent to fine-art printmaking and are not considered defects.
7. Shipping & Delivery
Risk of loss for products passes to you upon delivery to your shipping address. We arrange shipping with reputable carriers and provide insurance on framed works; our coverage for damage in transit and lost shipments is governed by our Return Policy, which sets out the situations in which we will replace or refund a work at our cost.
We are not responsible for carrier delays beyond reasonable rebooking efforts, customs holds, import duties, or weather-related disruptions. See our Shipping & Handling page for current carriers, timeframes, and international restrictions.
8. Returns & Refunds
All returns are governed by our Return Policy, which is incorporated into these Terms by reference. Because every print is produced to order, we cannot accept returns for change of mind or wrong size. Damaged, defective, or incorrect items are covered under that policy.
9. Intellectual Property
All photographs, images, text, design elements, software, and other content on the Site are the intellectual property of Photo & Craft, our represented artists, or our licensors, and are protected by U.S. and international copyright, trademark, and other laws. Nothing on the Site grants you any license to reproduce, distribute, modify, publicly display, or create derivative works from this content except as expressly permitted in writing.
Purchasing a print transfers ownership of the physical object only. It does not transfer copyright or any reproduction, display, or commercial-use rights to the underlying image. The artist retains all copyright and reserved rights in the work.
10. Artist Submissions & User Content
If you submit work for consideration through our artist submissions process, or post reviews, comments, or other content to the Site ("Submissions"), you represent that the Submissions are your original work and do not infringe any third-party rights. You retain ownership of your Submissions.
By making a Submission, you grant Photo & Craft a non-exclusive, royalty-free, worldwide license to review, internally evaluate, and reference the Submission for the purpose of considering it for representation. We will not publish, reproduce, or commercially use a portfolio submission without entering a separate written agreement with you. Submissions of customer reviews and similar public content may be displayed on the Site and used in our marketing.
11. Acceptable Use
You agree not to use the Site to:
(a) violate any law or regulation; (b) infringe the intellectual property, privacy, or other rights of any third party; (c) reproduce, scrape, or redistribute Site content for commercial purposes without our written permission; (d) introduce viruses, malware, or other harmful code; (e) attempt to gain unauthorized access to any part of the Site or our systems; (f) interfere with the proper functioning of the Site; or (g) submit false or misleading information.
12. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted access.
We do not warrant that the Site will be error-free, secure, or available at any particular time. Color reproduction, screen rendering, and product appearance may vary. Our limited quality guarantee for prints is set out in our Return Policy.
13. Limitation of Liability
To the maximum extent permitted by law, Photo & Craft and its officers, members, employees, agents, artists, and contractors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Site or any product purchased from us, regardless of the legal theory.
Our total cumulative liability for any claim arising out of these Terms or your purchase shall not exceed the greater of (a) the amount you paid for the product giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Photo & Craft and its officers, members, employees, agents, artists, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Site, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any Submission you provide.
15. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fires, floods, earthquakes, pandemics, public health emergencies, labor disputes, supplier failures, carrier disruptions, government actions, war, terrorism, civil unrest, or interruptions in utilities or telecommunications. In such cases, we will use reasonable efforts to fulfill orders as soon as practicable.
16. Dispute Resolution & Arbitration

Informal Resolution. Before initiating any formal proceeding, you agree to first contact us at hello@photoandcraft.com with a written description of the dispute and to allow 30 days for good-faith resolution.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product purchased from us that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in San Francisco County, California, or by remote hearing where available. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action & Jury Trial Waiver. You and Photo & Craft each agree that any proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate claims of multiple persons. You and Photo & Craft each waive any right to a jury trial.
Exceptions. Either party may bring a claim in small claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or equitable relief in court for actual or threatened infringement of intellectual property rights.
30-Day Opt-Out. You may opt out of these arbitration provisions by sending written notice to hello@photoandcraft.com within 30 days of first agreeing to these Terms. Opt-out notices must include your name, mailing address, email used for orders, and a clear statement that you decline arbitration.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Subject to the arbitration provision above, any action that is not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
18. Changes to These Terms
We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated by email or a prominent notice on the Site before they take effect. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
19. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Photo & Craft regarding the Site and your purchases.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Survival. Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive termination of these Terms.
